Ownership of Site; Agreement to Terms of Use, UPDATED

These Terms and Conditions of Use and Privacy Policy (the “Terms of Use”) apply to the A&A Consultant, its subsidiaries, affiliates and associated companies (the “A&A”or "We" or "Us" or "Our") web site logically located at (but not limited to) www.hkaac.net and hkaac.weebly.com and abelklau.wix.com plus abelklau.wixsite.com and all it’s Sub-web sites, and all linked Cloud Documents Download areas (excluding the links to external websites), plus link to www.hkaac.net and/or abelklau.wix.com and/or abelklau.wixsite.com, all it’s sub-web sites and linked Cloud Documents Download areas by A&A, (collectively, the “A&A's Sites”). The A&A's Sites is the property of A&A and its Content suppliers.

BY ENTERING AND CONTINUING TO USE A&A'S SITES AND / OR ANY OTHER WEB PAGES, YOU ARE DEEMED TO HAVE READ, IRREVOCABLY AND UNCONDITIONALLY ACCEPTED AND BE BOUND BY THIS TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE A&A'S SITES.

A&A reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the A&A's Sites following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use,  A&A  hereby only grants you a basic, personal, limited, non-exclusive, non-transferable, revocable license for the term hereof to access the A&A's Sites.

Content, UPDATED

All text “text Content”, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code “non-text Content”(collectively, “Content”), contained on the A&A's Sites are owned, controlled or licensed by or to A&A and its Content suppliers, and should be protected by international copyright laws.

Except as expressly provided in Terms of Use, Content here is restricted to the one-time downloading and saving on private devices, and no part of the A&A's Sites and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without A&A’s express prior written consent.

You may use information on A&A’s services and products (such as data sheets, knowledge base articles, and similar materials) purposely made available by A&A for downloading from the A&A's Sites, provided that you

(1) not to remove, modify or obstruct any Proprietary /Agency notice language in all copies of such documents,

(2) use such information only for your personal, institute internal non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media; In particular, any sale use of the Content is prohibited.

(3) make no modifications to any such information, and

(4) not make any additional representations or warranties relating to such documents.

The A&A copyright protected text contents found on the A&A's Sites may be reproduced and distributed free of charge in any

format or medium for personal or internal use within an organisation, and non commercial  subject to the following conditions:

(a) such text contents must be reproduced accurately and must not be used in a manner adversely affecting any moral rights of A&A; and

(b) A&A must be acknowledged as the copyright owner of such text contents and acknowledgement must be given to "the A&A's Sites (www.hkaac.net)" as the source of such text contents. Please note that the permission given in here only applies to A&A copyright protected text contents found on the A&A's Sites.  

A&A reserves the right to withdraw any permission given here at any time without any prior notice to you.

(c) Where third party copyright is involved in the text contents found on the A&A's Sites, authorisation or permission to reproduce or distribute or otherwise use any such text contents must be obtained from the copyright owners concerned.

Insofar as the content is not created by the operator, in particular contents of third parties, which appear on the A&A's Sites are mainly for the purpose of  research and private study only. Should you still be aware of copyright infringement, you can file a copyright infringement notification with us (A&A) by sending a written notification that includes substantially the information required by and stated the applicably Copyright Act.

By sending a written statement that contains: 

(a) identification of the copyrighted work and/or intellectual property right claimed to have been infringed; 

(b) identification of the allegedly infringing material on the Site that is requested to be removed; 

(c) your name, address, and daytime telephone number, and an e-mail address if available; 

(d) a statement that you have a good faith belief that the use of the copyrighted work and/or exercise of the intellectual property right is not authorized by the owner, its agent, or the law; 

(e) a statement that the information in the notification is accurate, and, under penalty of perjury, that the signatory is authorized to act on behalf of the owner of the right that is allegedly infringed; and

(f) the signature of the intellectual property right owner or someone authorized on the owner’s behalf to assert infringement of the right.

The A&A's Sites implements the“notification and takedown” procedure upon receives proper notification of claimed copyright infringement. The takedown procedure will respond expeditiously by removing, or disabling access to, the material that is claimed to be infringing or to be the subject of infringing activity.

You agree and undertake not to take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the A&A's Sites or the Site’s systems or networks, or any systems or networks connected to the A&A's Sites

Hyperlinks from the A&A's Sites to third party site

The A&A's Sites may contain links to other independent third-party Web sites (“Linked Sites”). These Linked Sites are provided solely as a convenience to our customers. Such Linked Sites are not under A&A’s control, and A&A is not responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on such Linked Sites. You will need to make your own independent judgment regarding your interaction with these Linked Sites.

Upon your leaving the A&A's Sites and go to the linked website, you will be subject to the terms of use and privacy policy of the linked website. You are highly advised to read such terms of use very carefully.

The A&A's Sites may apply iFrame (the HTML containers) technology to embed partially or wholly the contents of third parties’ websites, for the purpose merely for information for our visitors  and easier their interaction with the A&A's Sites. Such external links are dynamic cross-references. A&A checked them for the very first time of linking for whether the external content is  appropriate  according to independent judge . A&A is not obligated to continuously control changes in the external content, to which they refer to, towards changes, which could also lead to different responsibilities. Only if noticed or indicated by others that external content contains elements which would lead to responsibilities according to civil or penal law, the reference will be removed as far as technically possible and reasonable.

And we use the iFrame codes recommended by the host company of the A&A's Sites. And we truly believe and accept those iFames codes should not harmful to the linked websites. Insofar as the iFrame codes are not created by the operator, should you still be aware of negative drawback to your websites, we ask for a hint. Upon notification of violations, we will remove the iFrame codes/links immediately.

Mobile Webpages

In respect of the mobile version webpages, you acknowledge that the designated mobile telecommunication devices made accessible to the A&A are able to access only certain Internet addresses, that you can only view documents the formats of which are supported by our designated software and that certain pop-up windows may not be supported and you acknowledge that any alteration, reconfiguration or similar acts done to the relevant mobile telecommunication devices (including the hardware and software contained therein) would result in the alteration of the said design and may cause the Services to be disrupted and/or become inaccessible.

You understand and acknowledge that A&A is not the manufacturer of the relevant mobile telecommunication devices nor a wireless telecommunication service provider and A&A shall, in no event, be liable for any direct, indirect, incidental, special, consequential or exemplary damages resulting from 

(a) the use or failure to use the Services via the relevant mobile telecommunication device(s); 

(b) the access or failure to access the mobile channel via the relevant mobile telecommunication device(s); 

(c) any matters relating to any use of or the failure to use the relevant mobile telecommunication device(s)relating thereto; and 

(d) any damage or loss of data to your mobile telecommunication device whether or not caused by the use of the A&A website.

We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in section “Information Required by Law” to send us promotional and information material that we have not expressly requested. The operators of this website and its pages reserve the express right to take legal action in the event of the unsolicited sending of anything which constitutes junk mail, spam, or unauthorized advertising.

Changes and clarifications will take effect immediately upon their posting on the A&A's Sites. If we make material changes  to the policy, we will notify you here that it has been updated.

Several Users

If there are two or more persons adhering to these Terms of Use as user, their liability under the Terms of Use is joint and several, and their rights are joint.

Partial Invalidity & Severability

the “Terms of Use” constitute the entire agreement with respect to your access and use of the A&A's Sites. If any provision in the “Terms of Use” is illegal, invalidity or unenforceable under the law of any jurisdiction, or conflicts with other the “Terms of Use”, then that provision shall be deemed severable from the remaining provisions and shall not affect the validity and enforceability of the remaining provisions, or the validity and enforceability of that provision under the laws of any other jurisdiction.

Jurisdiction - Applicable Law

 

The use of the A&A's Sites shall be interpreted and governed by the Laws of the Hong Kong Special Administrative Region. Any dispute or difference arising from the use of the A&A's Sites, even in the event of multiple defendants or the introduction of third parties, shall be subject to and irrevocably submitted to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.

Chinese Version

 

If there is any conflict or difference between the Chinese version its English version, the English version prevails. If any part of the Chinese version is unclear, reference should be made to the English version. The Chinese version may not be translated into English for the purpose of comparing with or interpreting the English version.
